Plain View/Open Fields Case Study

ADJ 275

The Fourth Amendment to the U.S. Constitution presents that individuals have the freedom from unfavorable searches and seizures.  An investigation is described as a governmental invasion towards a place in which an individual carries a justifiable as well as sensible expectation of solitude. A seizure is explained as the exercise of governmental command over a person or thing.  What will be acceptable within the Fourth Amendment would rely on the situations.  For instance, some searches and seizures are thought acceptable only when the government first acquired a warrant permitting the measures, although some other searches and seizures are justifiable with no warrant.
