Assume that the new President of the U.S., Morgan Klump, decides to bar all children of undocumented workers residing in the U.S. from attending public schools and issues an executive order to this effect. In response to this initiative, the Center for Constitutional Rights files a lawsuit challenging this executive order on two grounds: 1) there is a fundamental right to education and 2) denying children access to education on the basis of their parents’ residential status violates equal protection.
